Coinbase blasts SEC for failing to respond to court order

Coinbase argued the SEC is reluctant to tell the Court of updates on its decision, stating it “bristles even at being ordered to update the Court on its progress”

Coinbase has criticised the US Securities Exchange Commission for failing to answer questions asked in the U.S. Court of Appeals as part of its continuing legal fight with the agency.

In a letter filed in the Court on June 17, Coinbase’s lawyers for the crypto exchange accosted the SEC for continuing to provide “no straight answers” to the Court with regards to the crypto exchange’s rulemaking petition, which calls on the Securities Exchange Commission to set up a regulatory framework for digital assets.

When ordered by this Court to address the sharp inconsistency between its litigating position and its actions and statements elsewhere, the Securities Exchange Commission still provides no straight replies and rather repeats its talking points, stated Coinbase’s letter.

The letter was in reaction to the Securities Exchange Commission’s June 13 submission seeking an additional 120 days to respond to Coinbase’s rulemaking petition.

Coinbase argued the Securities Exchange Commission is hesitant to tell the Court of updates on its decision, stating it “bristles even at being ordered to update the Court on its progress.”

The company argued the effect of the SEC’s silence, the long delays and its enforcement actions continue to weigh on the crypto industry and Securities Exchange Commission chair Gary Gensler continues to charge well down the path to irreversibly damaging a U.S. public firm and a whole industry.

On June 17, Coinbase’s CLO, Paul Grewal, stated in a series of tweets that it is unusual for the government to flout a direct question from a federal court.

Grewal stated he is hoping for the Court to grant a writ of mandamus — a court order to a government official ordering them to carry out their official duties under the law — given that the SEC knocked back Coinbase’s petition.

The crypto exchange is also submitting that the court rather set a deadline of 60 days or less beginning from June 13 — the date of the SEC’s request.
