Judge turns down SEC’s attempt to appeal Ripple ruling

Federal judge Analisa Torres issued her decision Wednesday in a case involving Ripple Labs and its XRP token, saying there was no “substantial ground for difference of opinion” about her findings

A US judge rejected an attempt by the Securities and Exchange Commission (SEC) to appeal a ruling that digital tokens are not securities when sold to the general public, another blow to the SEC’s attempts to regulate the industry.

Federal judge Analisa Torres in the Southern District of New York issued her decision Wednesday in a case involving Ripple Labs and its XRP token, saying there was no “substantial ground for difference of opinion” about her findings.

Torres was the judge who ruled in July that XRP was a security only when sold to institutional investors. The sale of XRP on public exchanges to retail customers, she said in July, did abide by federal securities laws.

Her initial ruling was celebrated as a victory in the crypto world, and her decision on Wednesday to dismiss the Securities and Exchange Commission’s appeal was also hailed by some industry participants.

This victory is another example of a court stopping the Securities and Exchange Commission’s attempts of regulation by enforcement against crypto companies, said Daniel Stabile, a legal partner with the law firm Winston & Strawn, which represents both Ripple Labs and crypto currency exchange Binance in other legal matters.

XRP, the fifth-biggest crypto token, which was originally created and issued by Ripple Labs, added 5% Tuesday.

Crypto stocks including those for Coinbase Global, Microstrategy, and bitcoin mining companies, Marathon Digital and Riot Platforms gained at Wednesday’s open between 1% and 3% but pared their gains by 11 a.m. ET.

The Securities and Exchange Commission and its chair Gary Gensler have contended repeatedly that certain crypto currencies are securities and therefore should be supervised by the agency, using that assertion as the basis for a number of lawsuits against top industry players.
